The one and only, the great ANNE FITZPATRICK presented on a topic near and dear to my heart- difficult witness prep (the prep is difficult because the witness is difficult, as opposed to the prep is difficult ‘cause there’s no good snacks)
This session was borne out of a complaint received about Anne’s conduct in a particular case. The complainer (the difficult witness) surreptitiously recorded Anne’s prep session with him and sent it, as ‘evidence’ of his various grievances. I listened to the hour recording, and it is ART. This surreptitious recording is the gold standard on how to handle a difficult witness in a firm and fair manner.
